The credit is only available to those whose adjusted gross income is below a certain threshold, which is set by the Internal Revenue Service (IRS) each year. In addition, the credit is only available to those who are enrolled in at least one course at an eligible institution on at least a half-time basis.

The amount of the Lifetime Learning Credit is based on the amount of tuition and fees paid and the individual's income. The credit can be worth up to $2,000 per tax year and is available to both single and married individuals. The credit is claimed using Form 8863, which must be attached to the individual's tax return.

It's important to note that the Lifetime Learning Credit is non-refundable, meaning it can only reduce an individual's tax liability to zero, but it cannot result in a tax refund. One notable court case involving the Lifetime Learning Credit is Commissioner v. Tufts, which was heard by the United States Court of Appeals for the First Circuit in 2002. In this case, the taxpayer, who was a graduate student at the time, claimed the Lifetime Learning Credit on their tax return and was subsequently audited by the IRS. The IRS argued that the taxpayer was not eligible for the credit because they were not enrolled in a degree program, but the court ruled in favor of the taxpayer, stating that the credit was available to those enrolled in courses taken to acquire or improve job skills, regardless of whether they were enrolled in a degree program.
