The mileage deduction is a common tax benefit that allows individuals to claim a deduction for the costs of using their personal vehicle for business, charitable, or medical purposes. However, the eligibility requirements for the mileage deduction are often the subject of debate and litigation, and there have been numerous tax court cases that have shaped the way that the Internal Revenue Service (IRS) and the courts approach these cases. Here are four key tax court cases involving the mileage deduction:

Commissioner of Internal Revenue v. Flowers: This case established that the mileage deduction is only available for individuals using their personal vehicle for business purposes. The Court held that a traveling salesman was entitled to claim a mileage deduction for the costs of using his personal vehicle to travel between his home and his customers, but was not entitled to claim a deduction for the costs of using his vehicle to travel between his home and his place of business.

O'Malley v. Commissioner of Internal Revenue: This case addressed the issue of whether an individual who uses a personal vehicle for both business and personal purposes can claim a mileage deduction for the entire cost of operating the vehicle. The Court held that the taxpayer was entitled to claim a deduction for the portion of his vehicle expenses that were allocable to business use, but was not entitled to claim a deduction for the portion of his expenses that were allocable to personal use.

Engle v. Commissioner of Internal Revenue: This case addressed the issue of whether an individual who uses a personal vehicle for charitable purposes is entitled to claim a mileage deduction. The Court held that the taxpayer was entitled to claim a mileage deduction for the costs of using his personal vehicle to perform charitable services, as long as he kept accurate records of his charitable miles and complied with other applicable requirements.

Knight v. Commissioner of Internal Revenue: This case, which was decided by the United States Tax Court in 2006, addressed the issue of whether an individual who uses a personal vehicle for medical purposes is entitled to claim a mileage deduction. The Court held that the taxpayer in this case was entitled to claim a mileage deduction for the costs of using her personal vehicle to transport her disabled child to medical appointments, as long as she kept accurate records of her medical miles and complied with other applicable requirements.

These tax court cases demonstrate the importance of keeping accurate records and being able to clearly demonstrate that your vehicle usage meets the eligibility requirements for the mileage deduction. If you are considering claiming a mileage deduction on your tax return, it is important to consult with a qualified tax professional and carefully review the applicable rules and requirements.
